Although India takes pride in being among the first countries in the world to develop legal and policy frameworks guaranteeing access to abortion and contraception, women and girls continue to experience significant barriers to the full enjoyment of their reproductive, conjugal as well as matrimonial rights. This includes poor quality health services and denial of decision-making. India’s matrimonial laws touch upon several aspects of sexuality and reproduction, including the role of sex and reproduction in marriage. In their various pronouncements, the Judicial system of India has recognized sexual and reproductive autonomy as an inalienable right of an individual. Despite this, challenges to women’s sexual and reproductive autonomy continue to exist in practice. This three-day training course will enlighten the participants with the nuances of the reproductive and conjugal rights of women in India. The entrenched issues like restitution of conjugal rights and its implications on rights to sexual and reproductive autonomy and health, denial of sex within marriage perceived as cruelty, marital rape, and so on, will be dealt with. Reproductive rights are essential to the realization of all human rights, encompassing a spectrum of civil, political, economic, and social rights. Horizons like these will also be discussed. This course will be conducted by expert resource persons comprising legal practitioners, civil society activists, professionals, and academics. It is high time that Indian society realizes that marriage- whether it be a sacrament or contract, does not result in ceding of the autonomy of one spouse to another.
