India, grappling with severe climate impacts such as heatwaves, cloudbursts, and extreme winters, is committed to these international treaties as reflected in Article 253 of the Indian Constitution. However, the reliance on these treaties must be balanced with the fundamental rights of the people, particularly as enshrined in Articles 21 and 14 of the Indian Constitution. The case of M.K. Ranjitsinh and Others v. Union of India marks a historic moment in India’s judicial landscape. The court’s final judgment has significantly contributed to the evolution of constitutional climate litigation in India and set a precedent worldwide. The decision is notable for establishing firm constitutional foundations for human rights related to climate change in the absence of clear constitutional guidance.
